Sales and Delivery Terms and Conditions

Validity of Terms and Conditions

Our general terms and conditions apply to each and every business transaction, whereby no other sales conditions may be considered. The terms and conditions herein shall be acknowledged by you as soon as you submit your order, however, no later than after the receipt of our shipment and shall apply equally for further transactions. Other agreements shall require our written consent. The modification or waiver of individual provisions shall not affect the validity of other provisions.

Orders and Prices

The sale is definite. An invoice shall be issued for deliveries of samples or product selection, but these can be returned upon indication of an invoice number. The prices are regulated by price lists applicable on the day of an order submission. We reserve the right to make modifications of prices or other provisions, even without prior notice.

Non-Stock Items

The orders of items that are not in stock, i.e. the items we obtain exclusively for you, can be neither modified, nor cancelled after you get our written confirmation. Packaging of our suppliers shall be accepted.

Guarantee of Further Purchases and Modification of Product Lines

We are not able to guarantee that further purchases will be possible. Form, glazing, surface quality or material composition of products can differ depending on a product line of our supplier.

Order Value and Shipping Cost in Switzerland

If net order value is CHF 500,00 or more, the delivery to your home is free of charge. Should the net order value be less than CHF 500,00, the order is packaged and shipped at your expenses. Additional services for shipments such as shipment notifications, fixed delivery times and deliveries to upper floors, as well as storage fees and fees due to undeliverable shipment shall be generally charged to buyers, whereas the same shall apply to free deliveries. International deliveries shall be delivered ex-works.

Shipping and Delivery

Shipping shall be executed on customer’s account and risk. Our deliveries are not insured. Potential damage shall be announced to the supplier immediately after the delivery. Delivery times are not obligatory. We reserve the right to perform partial deliveries. We shall try to keep the stipulated delivery times; however, we refuse compensation claims in case of a delayed delivery.

Payment Conditions

The net price shall be due in full amount within 30 days. Illegitimate discounts shall be reclaimed by a debit note. In case of any outstanding payments interests on payment in amount of 5 % shall be charged.

Retention of Title

The goods shall remain in our ownership as long as the purchase price is paid in full amount.

Complaints and Returned Deliveries

A delivery shall be checked for completeness and damage immediately after the receipt. Complaints shall be taken into consideration only within eight days from the goods delivery, and only with an attached delivery note or delivery note number. If a delivery is demonstrably defective, a substitute delivery shall be made free of charge. Further claims shall not be possible. Returned deliveries shall be accepted only after prior written consent and after the acceptance of a share on expenses. There is no credit note for goods that are not specified in the catalogue, not available anymore, incomplete and/or not returned in the original packaging, or that are not in impeccable state anymore.

Place of Performance and Jurisdiction

Place of perfomance and jurisdiction is Emmen, canton of Lucerne, Switzerland; unless being the subject to other mandatory jurisdictions.
