Terms and conditions of sale and delivery
Validity of the terms and conditions of business
Our general terms and conditions of sale and delivery shall apply to all business transactions, to the exclusion of any conflicting conditions of purchase. These terms and conditions are acknowledged by you when you place your order, but no later than upon receipt of our delivery, and shall likewise apply to future business. Differing agreements require our written confirmation. In the event of waiver or amendment of individual conditions, all the other conditions shall remain in force.
Orders and prices
The sale is definitive. Consignments of samples or selections are billed, but can be returned, stating the invoice number. The price list applicable on the date on which the order is placed shall be the basis for pricing. Changes to prices and other terms and conditions of sale are reserved at any time, even without prior announcement.
NS articles (non-stock articles)
Orders for articles which do not form part of our basic stock range, i.e. which we procure specially for you, can neither be changed nor cancelled after we have received your written confirmation. Our supplier’s packaging unit must be respected.
Further purchase guarantee and range changes
We cannot give a guarantee that further purchases will be possible. Depending on our suppliers’ production series, the form, glazing, surface quality and material composition of the products may change.
Order value and dispatch costs within Switzerland
For a net order value of CHF 500.00 and above, we deliver free specified destination. If the net order value is less than CHF 500.00, dispatch and packaging are billed at cost price. Consignment supplements for notified, stipulated date and upper floor deliveries, for storage charges and supplements for non-deliverability will generally be billed to the purchaser, even in the case of deliveries free destination.
Deliveries to other countries shall be made ex-works.
Dispatch and delivery
Dispatch is made for the account and at the risk of the purchaser. Our deliveries are not insured. Any damage must be notified to the carrier who makes the delivery immediately upon receipt. Delivery dates are not binding. We are entitled to make part-deliveries. We use our best endeavours to respect the agreed delivery dates, but decline claims for compensation in the event of late delivery.
30 days net. Unauthorized discounts will be charged back. In the event of late payment we charge 5% interest on arrears.
Reservation of ownership
The goods remain our property until the purchase price has been paid in full.
Complaints and returns
The delivery must be checked immediately by the purchaser to make sure that it is complete and in good condition. Complaints can only be considered within eight days of receipt of the goods, enclosing the delivery note or quoting the delivery note number. If the delivery is demonstrably defective, a replacement will be provided free of charge. More far-reaching claims for replacement are specifically declined. Returns will be accepted only by prior written agreement and with the deduction of a share of the costs. No credit will be granted for goods which are not listed in the catalogue, are no longer current, are incomplete and/or not in their original packaging, together with goods which are no longer in perfect condition.
Place of performance and jurisdiction
The place of performance and jurisdiction is Emmen. VE = packaging unit – please respect the packaging units shown in the catalogue. NL = not included in the Sola standard range, i.e. not in stock. The delivery lead-time for such articles is longer. The supplier’s packaging unit must be respected in every case. Returns are not permitted.
